This privacy policy (“Policy”) explains our policy regarding the collection, use, disclosure and transfer of informations etc. through “Eaccounts Fintech Private Limited” or any of its affiliate(s) (“we” or “us” or “our”), which operates the company’s website https://hawksindia.in/ or www.hawksindia.in or ("Site"), “Hawks Eaccounts” (App/Brand”) available on Google Play Store and Apple App Store. It’s run on Android and Apple mobile and as well as Web App. and its included desktop tool for two way data sync, which will work only original Tally licence of user. This application runs on SAAS basis (software as a service). This application runs with the help of cloud server and internet connectivity. Data always sync and store on cloud server but all collective and actual data always exist on customer’s machine (no need to depend on our server). This Policy forms part and parcel of the Terms of Use for the Hawks Eaccounts App Services.

The “Hawks Eaccounts” provides facility to original Tally license user to access their business accounts data to their mobile or through Web. Currently it is providing rights to input few entries and display some commonly required reports as balance sheet, Profit & Loss, Trail Balance, Ledgers and stock related reports etc. wherein the user can input their accounting entries, view and share the reports and owner Dashboard for quick decisions. Please note that ‘Services’ would include any other future services we may provide or propose to provide.

In Future when we update, improve and expand the “Hawks Eaccounts” App Service, then this Policy may be changed accordingly. At the time of registration of Hawks Eaccounts App, the information provided by you like company name, address, email, contact person, contact number etc. Your consent to the collection, storage, and use of the personal information provided by you (is including, uses of any changes or other information regarding App services there to as provided by you) for any of the services that we offer.

We respect the privacy of the users of the Hawks Eaccounts App Services (“Users” or “you”) and are committed to reasonably protect it in all respects. The information about the User as collected by us is: (a) information supplied by Users and (b) information automatically tracked while using a mobile device having Hawks Eaccounts App Services enabled.

Remark: Use this “Hawks Eaccounts App and it’s services if you are agree to this Policy. If you do not agree with any term in this Policy, please do not use /avail the “Hawks Eaccounts” App any Services.

We collect information to provide better services to all our user under the brand “Hawks Eaccounts”. Hawks Eaccounts app and Web are working when you have got original license of Tally software. Our system software (sync tool) will be installed in user client machine where original Tally license already installed or run with the permission of user and mobile application will be installed in your mobile from Android or IOS play store. Our system software (sync tool) will communicate with your Tally data (for two way sync). It will always synchronize your Tally software data from our cloud server with data storage as general process and revers push this data into your mobile and Web, so that you can access your data anywhere anytime while your Tally software is offline or you are out of office.

We recognize the importance of maintaining your privacy. We value your privacy and appreciate your trust in us. We always recommend that before buying or using our application or services, read and understood all the related terms and conditions. We review our security measures are regularly and updated these as per technological developments. Regardless of where your personal informations are transferred or stored, we take all the steps reasonably necessary to ensure that this information is kept secure. But we may share information if we receive any order judicially or from government in order to comply with the Indian law.

Information supplied by users

To avail certain Services on the Hawks Eaccounts App, Users are required to provide certain personal information for the registration process which may include:
   • User ID, Company Name, Company Address, Contact Person, Contact Number, State, GST Number etc.
   • We collect user information for the purpose to inform about new updates and validation at the time of customer support.
Installed apps - the information about the apps installed on the user’s device.
   • Device or other IDs - Identifiers that relate to an individual device for the purpose of security (one device which customer has purchase for, should be run and access his data on same device).
Crash and Diagnosis - We collect crash log data from your app and the Information about the performance of your app for any technical diagnosis.
   • We collect information if you post a comment on our Platforms, websites or ask us a question through phone or email. We use tracking tools like Google Analytics, Google Webmaster, browser cookies and web beacons for collecting information about your usage of our Platform.
   • We use information to respond to your requests or questions. We might use your information to confirm your order or purchase or specification for your typical need(s).
   • We use information to improve our products and services. We might use your information to customize your experience with us. This could include displaying content based upon your preferences.
   • We use information to look at Platform trends and customer interests. We may use your information to make our Platforms and products better. We may combine information we get from you with information about you we get from third parties.
   • We use information for security purposes. We may use information to protect our company, our customers, or our Services.

The Information as supplied by the Users/customer enables us to provide the Services and improve the Hawks Mobile App Services and provide you the most user-friendly experience. In some cases / provision of certain service(s) or utility(ies), we may require your contact address as well. Further, upon downloading the App.

You may be assured that we do not share your registration information data with any third party except in order of government under law and policy.

All Information is service dependent and we may use the Information to provide the Services, maintain, protect, and improve the Hawks Eaccounts App Services/features, and for developing some new features.

We may also use your email address and phone number without further consent for our company internal use like information about marketing, non-marketing or administrative purposes (such as notifying you of major changes, for customer service purposes, providing information about updates to Hawks Eaccounts App Services, billing, etc.).

Information automatically tracked while using the App or Site

We store all customer device IP information to protect the unauthorised use of other device, when Hawks Eaccounts app will install and run in a device, then it will be locked to run same user id on other device until customer written request.
We use cookies and other technologies for analysing and optimising our websites as well as for marketing purposes. Our partners may also assign their own cookies to your browser, a process that we do not control.

Information sharing

This is company policy that we don’t share any customer’s Information to any third party, except only government order. We are providing data sync form customer’s machine to company server, but main/actual data always exist on customer’s machine.
In other way, Further, the User also consents to sharing of Information when it is requested or required by law or by any court or governmental authority to disclose, for the purpose of verification of identity, or for the prevention, detection, investigation including cyber incidents, or for prosecution and punishment of offenses.
These disclosures are made in good faith and belief that such disclosure is reasonably necessary for enforcing the Terms of Use or for complying with the applicable laws and regulations.
Any personal information of an individual User such as name, phone number, address, email address, user id etc. would not be shared with any other User and/or third party.

Collection of Other info and Messages information

We don’t collect, read or store your personal SMS from your inbox. We collect phone number and Email from customer’s given information to send the company information like updates, support and company info purpose so that who have subscribe or buy Hawks Eaccounts App can be updated by latest changes/updates and other information.

Compliance with Play Store App Guidelines

1. We, at Hawks Eaccounts, assure you that we are providing the facility to access your business data on your mobile as well as Web, adhere to the guidelines set by the Play store. We are committed to maintaining the privacy and security of your business information while ensuring a seamless experience.
2. Prohibition of Access to Sensitive Data: As a responsible of providing of your accounts data on your mobile and web, service provider, we strictly prohibit access to sensitive data, such as photos and contacts, from our users during lending activities. We understand the importance of safeguarding your personal information and prioritizing your privacy.
3. Restricted Permissions: In line with our commitment to protecting your privacy, the following permissions are explicitly prohibited while using our lending services:
   1. Read_external_storage: We do not request or require access to your external storage, ensuring that your personal files and data remain private and inaccessible to us.
   2. Read_media_images: We do not require permission to access your media images, ensuring that your photos and multimedia content is not accessible to us during the lending activities.
   3. Read_contacts: We strictly adhere to the principle of data minimization and do not access your contact information. Rest assured that we never access your contact list.
4. Access_fine_location: We do not seek access to your precise location data. We respect your location privacy and never access your location.
5. Read_media_videos: We do not require permission to access your media videos. Your videos and multimedia content are not accessed or utilized by us.

Information storage and backup

From time to time, we take backup of your data on Hawks Eaccounts App on our cloud database. This is done for the purpose of enabling Users to get their data back in case their phone's data becomes unusable, or phone gets lost, or the User moves to a new phone device. We also use this backup to provide useful insights and information related to their spends such as weekly spends in a month, insights related to spend behaviour, etc., and to provide information related to User spends, patterns and User data in the form of aggregated and anonymized statistics on data such as User spends by category, date, time, bank balances, etc.
We shall keep User’s Information in our records till the period of time where we can potentially offer the Hawks Eaccounts App Services to the Users. After such period of time where Hawks Eaccounts App Services are no longer relevant to a User, we remove all the Information pertaining to a particular User from our records

Information security

We take appropriate security measures to protect against unauthorized access to or alteration, disclosure or destruction of data including accidental or intentional manipulation, loss from access by unauthorised parties. All Information gathered on the Hawks Eaccounts App is securely stored within the controlled database. Access to the servers is password-protected and is strictly limited. Our security measures are regularly reviewed and updated to reflect technological developments.
Regardless of where user business data sync and transfer or store, we take all steps reasonably necessary to ensure that user accounts data/information is kept secure, however, please understand that no transmission of data over the internet or any other public network can be guaranteed to be 100% secure.
Although, we value your trust in providing us your Personal Information, thus we are striving to use commercially acceptable means of protecting it. But you are hereby notified that no method of transmission over the internet, or method of electronic storage is 100% secure and 100% reliable, and we cannot guarantee its absolute security.
We seek to ensure compliance with the requirements of the applicable data protection laws to ensure the protection and preservation of the User’s accounts data Information.

Log Data

We want to inform you that whenever you use our Service, in a case of an error in the app we collect data and information (through third party products) on your phone called Log Data. This Log Data may include information such as your device Internet Protocol ("IP") address, device name, operating system version, the configuration of the app when utilizing our Service, the time and date of your use of the Service, and other statistics.

Purpose of Data Syncing

We are providing original license Tally accounting software’s user to access their accounts data to his mobile and as well as Web. For the purpose of access accounts data 24x7 by user we have to sync his data on our cloud server and auto data sync (pull and push) is it always continue process. Although main and actual data will always remain user’s local machine. But yes, data flow in two ways auto sync in encrypted format so that user can access their data.

When you access or use the Services or send any data, query, request or communication to us via our Support email, you understand that you are communicating with us electronically, and that we may respond via electronic means from us, such as by email, sms, whatsApp etc.

Link to third-party and data Store

The App has a link to a registered third party. We never allow sharing user’s business account data with anyone or any third party.
The Company represents that the user data is stored on cloud (Amazon Web Services) in encrypted form under best industry standards and the same may change from time to time.
The app does use third party services that may collect information used to identify you.
Third-party service providers used by the app includes but is not limited to: (You may refer to their individual websites for their privacy policy)
   • Google Play Services & Other ancillary Google Products
   • Firebase & Google Analytics
   • AWS (Amazon Web Services)
   • SMS, IVR and WhatsApp Service Providers
   • GSTN API providers for Govt. portal syncing
   • Apple Store
   • Google Data Studio
   • And Development languages and tools etc.

We may see your primary Google account email address and avail your personal information that you may have made s publicly available. When you sign in with Google, you allow us to send emails on your behalf.

Security of Main data

Hawks Eaccounts is providing facility to users to access their business data on their mobile and as well as Web anywhere anytime, for the purpose of providing access we sync data but actual/main data is always store on client machine locally or on his cloud, with his personal protection and security

Updates/Changes

We may alter our Policy from time to time to incorporate necessary changes in technology, applicable law or any other variant. In any case, we reserve the right to change (at any point of time) the terms of this Policy or the Terms of Use. Any changes we make will be effective immediately on notice, which we may give by posting the new policy on the Site. Your use of the Hawks Eaccounts App Services after such notice will be deemed acceptance of such changes. We may also make reasonable efforts to inform you via electronic mail. In any case, you are advised to review this Policy periodically on the Site to ensure that you are aware of the latest version.

Account & Data Deletion From Company’s Server On User Request

If any user wants to quit or shift somewhere else or don’t want to use “Hawks Eaccounts” services then he is always free to exit from Hawks Eaccounts and we will remove his business accounts data/accounting companies on his request from our server. We have already given a request form for data removing on our website www.hawksindia.in whenever any customer want to quit and submit given form, company will confirm through his registered mail, if he confirm then in given time period (3-4 working days) user’s synced business data will be removed from our server.
